Na Modernidade filosófica, a expressão sui iuris torna-se comum nos textos políticos, em especial a partir do momento em que uma linguagem dos direitos subjectivos naturais se vai sedimentando e traduzindo uma certa perspectiva da liberdade individual. Assim, sui iuris é considerada expressão de direito designando um âmbito de autonomia ou independência individuais, uma espécie de espaço soberano de um direito pessoal. Em Spinoza, o sui iuris surge com frequência, mas só no Tratado Político atinge a sua máxima expressão, dentro (...) do binómio sui iuris / alterius iuris, o qual é habitualmente identificado com um de autonomia / heteronomia. Tentar-se-á aqui demonstrar que o sui iuris em Spinoza passa por uma transformação radical: não só não é necessariamente incompatível com o alterius iuris, como é-lhe dada uma dimensão epistemológica que se coaduna com uma soteriologia. Moral reasoning typically informs environmental decision-making by measuring the possible outcomes of policies or actions in light of a preferred ethical theory. This method is subject to many problems. Environmental pragmatism tries to overcome them, but it suffers also from some pitfalls. This paper proposes a new method of environmental pragmatism that avoids the problems of both the traditional method of environmental moral reasoning and of the general versions of environmental pragmatism. We call it 'justificatory moral pluralism' - it develops (...) the intuition that normative ethical theories need not be mutually exclusive. This leaves room for important forms of pluralist environmental ethics that do not require a once-and-for-all prior commitment to an ethical theory when deciding about policies or courses of action related to the protection of the environment. Justificatory moral pluralism offers a viable solution to the recurrent conflicts between efficient environmental decisions and the need for moral reasoning. (shrink)

A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. In the debate between the Historische Rechtschule (Hugo and Savigny) and Hegel about who is legitimately entitled to develop legal theory, the former considered philosophy of law to be inherent to systematic science of law, whereas the latter considered the concept of Law in a necessary transdisciplinary dialectic – there would then be a difference between ‘the jurists’ philosophy of law’ and ‘the philosophers’ philosophy of law’. I will demonstrate that such distinction cannot stand. A ‘jurists’ philosophy of law’ does (...) not exist precisely because legal norms and their application are merely one of the law’s moments. The law’s attitude is one of inclusion: philosophy of law’s disciplinary autonomy occurs in the law’s interdisciplinary immanence. (shrink)

O “paradoxo da liberdade” consiste em esta só poder ser atingida através da obediência, a qual é vista frequentemente como o contrário da liberdade. Neste artigo, demonstrar-se-á que o paradoxo começa por nascer em Maquiavel, o qual, porém, deixa-o em aberto ao colocar a liberdade tão-só dentro de um contexto de governação. Spinoza, contudo, dará um passo em frente na sua abordagem à liberdade política. Ele aborda esta problemática diretamente nos seus dois tratados políticos e ambos expressam o mesmo entendimento (...) da liberdade, embora através de diferentes instâncias terminológicas. A solução spinozana combina um conjunto de critérios variados para a determinação da liberdade política, tanto da perspectiva do indivíduo como da perspectiva do Estado. Todavia, a sua combinação não é simples cumulação, mas sim uma complexa escala permitindo medir a liberdade em graus. Dessa maneira, Spinoza consegue fazer com que diferentes tipos de liberdade se compatibilizem com diferentes tipos de obediência. (shrink)

Spinoza studies have paid little attention to the concept of justice for centuries. However, he refers to it quite often in different contexts, especially in his mature texts. More specifically, he defines it as synonymous with suum cuique tribuere, even though he fails to provide a reasonable account of how this traditional legal expression fits into his philosophical system. This article shows that there is a relevant philosophical dimension in Spinoza’s treatment of the suum cuique that emerges out of his (...) notion of equality. The main section identifies the connection between Spinoza’s references on justice as suum cuique and the different conceptions of equality that are inherent in his system (an ontological, a metaphysical, a productive (ethical), a legal, and a political equality). The conclusion tries to answer the question of whether such an understanding of the suum cuique as equality constitutes a theory of justice or not. (shrink)

This essay argues that legal efficacy understood as existent binding force and as dominance of a system of coercion vis-à-vis competing systems is not strictly a matter of fact, but involves what can be termed justified normativity in a factual context. The argument is divided into four sections. The first three sections describe different dimensions of a normative concept of legal efficacy applied to legal systems: efficacy as persuasiveness, as indirect communication, and as constitutive obedience. Neste artigo apresentamos, de forma concisa e em português, alguns elementos-chave dos principais debates contemporâneos na filosofia da memória. Nosso principal objetivo é tornar essas discussões mais acessíveis aos leitores de língua portuguesa, fornecendo uma atualização importante para esforços anteriores (Sant’Anna & Michaelian, 2019a). Começamos introduzindo a noção de viagem no tempo mental, a qual estabelece a base empírica para a metodologia empregada em trabalhos recentes, antes de apresentar dois debates centrais. Primeiro, o debate entre causalistas e simulacionistas sobre a (...) teoria da lembrança filosoficamente correta (§2). Segundo, o debate entre continuístas e descontinuístas sobre a relação entre lembrança episódica e certas formas de imaginação (em particular, o pensamento episódico acerca do futuro) (§3). Na segunda parte do artigo, apresentamos e exploramos dois tópicos de discussão crescente: a natureza do sentimento de passado característico da memória episódica (§4) e questões de meta-nível relativas ao próprio caráter das controvérsias exploradas na primeira parte do artigo (§5). O artigo discute como a teoria de gênero de Judith Butler, principalmente a partir do que a autora denominou de metafísica da substância, opera uma desontologização das experiências de sexo-gênero. Para isso, expõe-se como Butler opera a desontologização do sujeito generificado, através de sua crítica feminista acerca da ideia de sujeito concebida a partir do marco da diferença sexual. Posteriormente, dedica-se ao que Butler denominou de “metafísica da substância”, vista como o que sustenta, no marco do sistema de sexo-gênero binário, (...) a ideia de diferença natural dos corpos, momento no qual a autora recorre à genealogia da moral realizada por Nietzsche para justificar sua genealogia do gênero e dos corpos, vislumbrando esses como indissociáveis, razão pela qual conclui que, à maneira do gênero, a produção dos corpos ocorre de forma performativa através de recitações contextualizadas que estabelecem os marcos de inteligibilidade humana, os quais são, por isso, passíveis de transformação. This article proposes, with a focus on discussions around norms and bodies, to expose the conceptions of power, as well as the application of its concept, in Michel Foucault and Judith Butler. It begins by exposing the conception of power found in Foucault. After that, the connection between Foucault's thought and Butler's thought begins, explaining how Foucault's conception of power is inserted in the North American philosopher's theory of gender. Finally, the appropriations made by Butler of Foucault's thought regarding the (...) productive aspects of power in the fabrication of intelligible genres are exposed. (shrink)

Este artigo propõe-se a discutir, sob o paradigma do Estado Democrático de Direito, em que medida a aplicação da cota de gênero contribui para fomentar a representatividade feminina na política. Utilizam-se a pesquisa bibliográfica e o método jurídico-dedutivo. Os resultados sinalizam que não há uma correlação necessária entre o preenchimento da cota de gênero e o incremento do número de candidatas eleitas. Os resultados apontam que a superação dessa desigualdade requer a discussão de outras possibilidades, tais como reserva de vagas (...) no Legislativo, combate às candidaturas femininas fictícias e aplicação obrigatória de recursos nas campanhas femininas. O Questionário de Controle de Ansiedade-Revisado ( QCA-R ) foi desenvolvido para avaliar a percepção do indivíduo quanto a sua habilidade de controle diante de reações relacionadas à ansiedade. Objetivo. Adaptar o QCA-R para o português brasileiro e reunir evidências iniciais de validade de conteúdo, estrutura interna e relação com variáveis externas. Método. Participaram 293 indivíduos,com idade superior a 18 anos. Utilizou-se o QCA-R, o Patient Health Questionnaire -4 (PHQ-4) e um questionário sociodemográfico. Resultados. A partir de análise fatorial exploratória, (...) foi identificada solução unidimensional.Verificou-se validade baseada na relação com variáveis externas, sendo encontrada associação negativa e estatisticamente significativa entre o QCA-R e o PHQ-4. Concluiu-se que o QCA-R é um instrumento apropriado para uso com amostras brasileiras. (shrink)

Este artigo visa analisar modos de axiologizar o bem-estar na escola em enunciados produzidos por alunos do 9º ano do ensino fundamental de uma escola municipal do interior baiano. Interessa-nos, especialmente, compreender como os sujeitos semiotizam, em seus enunciados, o que consideram o evento mais marcante de suas experiências ao longo dos anos finais do ensino fundamental e o que isso nos informa sobre os valores ali mobilizados relativos ao papel social e institucional da escola e(m) suas modalidades de convivência (...) intersubjetiva. As análises destacam que as memórias verbo-visualmente materializadas não se limitam a registros, abrigados na consciência, mas são repositórios de experiências afetivas de e em diversos cronotopos. O fato de as memórias apresentadas recobrirem diferentes eventos interacionais oferecem-nos uma visão crítica dos estudantes de como percebem e matizam complexidades das interações por eles rememoradas e enunciadas. Trabalhos, como o nosso, que se interessam pelos afetamentos de alunos, contribuem, localmente, para que o contexto escolar seja (re)(des)coberto, tensionando como percepções sociais são semiotizadas em horizontes apreciativos de experiências. RESUMO Neste artigo, partindo de discussões da ironia como estratégia discursiva, propomo-nos a analisar se, e como, a ironia serve de zona de diálogo e de tensão entre diferentes vozes/dizeres, evidenciando-se como um discurso de resistência da mulher. Para tanto, partimos do entendimento de linguagem do chamado Círculo de Bakhtin e das discussões sobre ironia como estratégia discursiva, além de considerações sobre a chamada cultura do estupro e os mitos a ela relacionados. Tomamos como corpus comentários de mulheres nos quais (...) a ironia se faz presente, surgidos a partir de postagem anônima no Facebook, em páginas do tipo spotted1. A partir da análise dos dados, foi possível perceber que, por meio da apropriação dos discursos-mitos relacionados à cultura do estupro, as mulheres instauraram em seus enunciados zonas de tensão entre dizeres, caracterizando a ironia como discurso de resistência da mulher contra discursos machistas. Subject of constant reflections in other works and published studies, the theme of memory and its relations between past and present always provokes renewed perspectives regarding the readings of the ancient texts in our academic discussions. Analyzing the present time of a community behind an ancient document is likewise always challenging. However, in the present document (Mark’s Gospel), when analyzed in the light of heuristic concepts - such as memory, for example - there are very effective indications in proposing new (...) perceptions about the constant interaction between past memories and memory constructions in present times (of the ancient document that has been analysed). New horizons open up in the field of study of the texts that make up the New Testament when dialogues with psychology and research on memory. In this sense, this work applies the postulate of D.L. Schacter on the adaptations that are made in the memories of the past so that they meet the needs of the present to the gospel of Mark. It follows that the author of the said gospel rewrote the traditions received so that they answered questions that were made to them in the present. (shrink)

Resumo "O candomblé aceita o homossexualismo porque é uma religião que não tem pecado. Não interessa se você seja homem, mulher ou gay. Não importa a opção sexual. (...) Você pode ver. É uma religião de homossexuais". É assim que um filho-de-santo responde a uma pergunta sobre a notável presença de homossexuais iniciados na religião dos orixás. Se comparadas a outras denominações hostis e indiferentes às orientações não-heterossexuais, o candomblé e outras devoções afro-brasileiras são, de fato, mais tolerantes à participação (...) de homossexuais, permitindo-lhes ocupar todos os postos previstos na hierarquia ritual. Embora estejam entre as expressões religiosas que menos discriminam o indivíduo por razões de preferência sexual, percebemos por meio da literatura especializada e de uma pesquisa de campo, realizada na região metropolitana de São Paulo, que os candomblecistas também empregam em seus discursos argumentos ou narrativas míticas, certos princípios e valores seculares articulados à moralidade cristã e que dão sustentação à hierarquia de sexo/gênero - conforme alguns sacerdotes, as categorias homem/mulher e masculino/feminino devem corresponder às expectativas sociais esperadas para cada ser sexuado. Em virtude disso, tratar de homossexualidade nas comunidades-terreiro, ao contrário do que possa parecer, é um tema delicado, restrito e rodeado de tabus. Palavras-chave: Candomblé; Gênero; Sexualidade; Homossexualidade." Candomblé accepts homosexualism because it is a religion where sin does not exist. It does not matter whether you are a man, a woman or gay. Your sexual choice does not matter. [...] You can see it. It is a religion of homosexuals." This is how a filho-de-santo answers a question about the remarkable presence of homosexuals initiated into the orixás ' religion. If compared to other denominations, hostile or indifferent to nonheterosexual orientations, candomblé and other Afro-Brazilian religions are indeed more tolerant to the participation of homosexuals, allowing them to hold all positions in the ritual hierarchy. However, based on the literature and on a field research carried out in the São Paulo metropolitan region, we realized that those affiliated to candomblé , although following one of the religions with the lowest degree of prejudice against individuals due to their sexual preference, also employ in their discourse arguments or mythical narratives, secular principles and values articulated with Christian morality, which support the sex/gender hierarchy: according to some priests, man/woman and male/female categories must correspond to the social expectations of each sexual being. Thus, on the contrary, approaching homosexuality in Afro-Brazilian religious communities is a delicate and restricted matter, surrounded by taboos. Como entender o “idealismo alemão”? Propõe-se aqui, a partir do choque entrealgumas posições sobre a filosofia kantiana (sobretudo em Schopenhauer e em Schelling),antes do que uma resposta, articular alguns problemas em torno do “idealismo alemão”,procurando pensar, assim, tanto a ambigüidade deste recorte como operador heurísticoquanto a abertura possível para um campo de questões sobre a atividade filosófica e o seu(não) fundamento.

Mesmo diante do violento processo de desterritorialização vivido pelas inúmeras comunidades africanas no contexto da dominação colonial europeia, práticas e saberes ancestrais foram ressignificados e reelaborados de forma a impregnar o tecido social das culturas negras das Américas. Nesta perspectiva, este artigo insere-se em um conjunto de reflexões que visam exaltar a importância da preservação de memórias afrodiaspóricas no Brasil. Para tanto, particulariza-se um território negro no município de São Paulo, o bairro da Casa Verde na zona norte da cidade. (...) Com base na História oral e na pesquisa de campo, o objetivo central da presente pesquisa é sugerir possíveis traduções acerca da presença e permanência de ancestralidades negro-africanas na urbe paulistana a partir das narrativas compartilhadas e dos trabalhos de memória de Lucinda de Oliveira Marcelino. A colaboradora/narradora é filha de uma das fundadoras da Irmandade de São Benedito da Casa Verde, inaugurada em 1941. O acesso às memórias reconstruídas de Dona Lucinda permitem sinalizar a presença de práticas ancestrais marcadas por cosmovisões herdadas e protagonizadas por mulheres. Tais concepções constroem identidades afirmadas que singularizam as experiências negras na metrópole, expressando valores civilizacionais e extraocidentais comunitários fundamentais à humanidade. O presente texto versa sobre as utilizações políticas que a conversão dos grupos indígenas suscitou na fronteira amazônica. A fronteira a que aludimos aqui diz respeito aos rios Marañon, Solimões e Negro, onde os limites das colônias europeias se encontravam. Se por um lado havia o caráter espiritual, em reduzir os indígenas a fé católica, por outro, as conversões foram amplamente utilizadas pelos estados ibéricos para garantir sua zona de influência, além de garantir a supremacia econômica no vale amazônico. E (...) além dos ibéricos, a conversão foi uma política na qual os indígenas se aproveitaram para tirar vantagens da condição de “vassalo do rei”, que o fato de se tornar católico expressava. Desse modo, o presente trabalho dialoga com os estudos de fronteira, sobretudo, com a noção de Missão como instituição de fronteira, além do Protagonismo Indígena, em demonstrar a perspectiva dos grupos nativos, frente ao processo de conversão. O presente trabalho teve por intenção discutir as mudanças nos planos econômicos, político - via acumulação flexível - e culturais - via discurso pós-moderno, que trazem mudanças para a manifestação cultural do futebol. À luz do materialismo histórico e dialético foi possível compreender que o fenômeno futebol tem passado por um processo de mercadorização cujo grande interesse, no campo do espetáculo, não é proporcionar para os espectadores um futebol arte, como já existiu, mas sim, movimentar uma indústria esportiva bilionária.

One of the suggestions to bypass the epistemic requirement of political agency and to encourage the inclusion of infants in representative democracies is to resort to proxies or surrogates who share or advocate interests which may be coincidental with their interests. However, this solution is far from desirable, given that it privileges the political agency of parents, guardians and trustees over other adult citizens. This article offers an (...) alternative to this conceptual frame of reference by making a case for the political agency of infants. Firstly, it maintains that political agency can be understood in terms of the several facets involved in political representation. Secondly, it claims that the all-affected principle can be reformulated as an ‘infant-affected-interests principle’ in light of which infants are members of the class of the represented. Thirdly, it explores the ways through which this political agency can occur without having to resort to alternative conceptions of representation. The conclusion ascertains that infant enfranchisement is highly undesirable and that there are more viable forms to promote infant political agency, such as virtual representation, infant-beneficial principles of political action and ombudspersons for infants. Este artigo pretende apresentar as “representações obscuras” como parte da via disponível para se conceber um cultivo de si e da civilização, de acordo com a perspectiva de uma antropologia pragmática tal como concebida por Kant. As representações obscuras marcam a existência de um campo de representações intelectuais, estéticas e morais ocultas à consciência. Estas representações possuem, de um lado, a finalidade de fornecer um _cultivo de si_, espécie de conhecimento da natureza humana, por meio de sua funcionalidade empírica na (...) produção de determinados fenômenos, e, de outro, proporcionar as condições adequadas para a construção da civilização, por meio da “arte de ocultar” as verdadeiras intenções nos comportamentos em sociedade. Nos dois casos, o estudo dessas representações contribui para a compreensão do interior do ser humano, fornecendo uma via adequada para seu uso pragmático-prudente no mundo, o que justifica o prevalecimento privilegiado do tema nos escritos de antropologia. A partir da instituição da Estratégia Nacional de Educação Financeira (ENEF), em 2010, no Brasil e da recomendação da Base Nacional Comum Curricular (BNCC) para a incorporação de temas como educação para o consumo, educação financeira e educação fiscal, não de forma transversal e inclusiva, o estado do Paraná incorporou o componente curricular de Educação Financeira, em 2021, para cada série do Ensino Médio de todas as escolas da rede pública de ensino estadual, incluindo escolas localizadas em áreas de Reforma (...) Agrária.Este artigo tem por objetivo apresentar e analisar as potencialidades de uma proposta de abordagem marxista para o componente curricular da Educação Financeira, em particular, com a temática do lucro, desenvolvida no curso da 1ª série do Ensino Médio, em uma escola campo localizado na área de assentamento da Reforma Agrária, considerando as orientações pedagógicas da Secretaria de Educação do Estado do Paraná do Movimento dos Trabalhadores Rurais Sem Terra (MST). Com base no materialismo histórico-dialético, esta pesquisa percorre três etapas: primeiro, a elaboração de uma proposta, considerando as diretrizes pedagógicas do MST; segundo, aplicação da proposta; e, em terceiro lugar, analisar dois resultados.A produção de dois dados da pesquisa foi realizada por meio de gravação de áudio das aulas, com posterior transcrição. As aulas serão organizadas de forma expositivo-diáloga, com questões norteadoras para o desenvolvimento de dois conceitos, de modo que os alunos apresentem suas concepções sobre os temas abordados e o professor se posicione como mediador no processo investigativo. Neste artigo, a análise está centrada apenas em uma sala de aula, na qual os objetos de conhecimento abordados são: origem do lucro e relação entre lucro e trabalho.Concluiu-se que a aplicação da proposta possibilitou a alguns distinguir aparência e essência do tema abordado, na medida em que superaram a visão inicial que apresentavam de que o lucro advém necessariamente do capital comercial, por entender que ele era trabalho aconselhado ou produtivo. Dessa forma, podemos compreender a origem do lucro através de uma perspectiva histórica e, principalmente, perceber a contradição entre lucro e trabalho. Na medida em que ultrapassaram a visão inicial que apresentavam de que o lucro resulta necessariamente do capital comercial, deixando de compreender que ele provém do trabalho produtivo. Dessa forma, podemos compreender a origem do lucro através de uma perspectiva histórica e, principalmente, perceber a contradição entre lucro e trabalho.Na medida em que ultrapassaram a visão inicial que apresentavam de que o lucro resulta necessariamente do capital comercial, deixando de compreender que ele provém do trabalho produtivo. European Journal of Political Theory, Volume 21, Issue 2, Page 368-389, April 2022. Epistemic impairment has been the decisive yardstick when excluding infants from political agency. One of the suggestions to bypass the epistemic requirement of political agency and to encourage the inclusion of infants in representative democracies is to resort to proxies or surrogates who share or advocate interests which may be coincidental with their interests. However, this solution is far from desirable, given that it privileges the political agency (...) of parents, guardians and trustees over other adult citizens. This article offers an alternative to this conceptual frame of reference by making a case for the political agency of infants. Firstly, it maintains that political agency can be understood in terms of the several facets involved in political representation. Secondly, it claims that the all-affected principle can be reformulated as an ‘infant-affected-interests principle’ in light of which infants are members of the class of the represented. Thirdly, it explores the ways through which this political agency can occur without having to resort to alternative conceptions of representation. The conclusion ascertains that infant enfranchisement is highly undesirable and that there are more viable forms to promote infant political agency, such as virtual representation, infant-beneficial principles of political action and ombudspersons for infants. This paper aims at answering some of the objections to the NIP’s criticism of the idea of rights of future persons. Those objections usually adopt different perspectives depending on how they understand differently the nature of the correlativity between rights and duties – some adopt a present-rights-of-future-persons view, others a future-rights-of-future-persons view, others a transitive present-rights-of-present-persons view, and others still an eternalist view of rights and persons. The paper will try to show that only a non-transitive present-rights-of-present-persons view can survive (...) the challenges posed by the notion of correlativity inherent in the NIP, and thus preserve rights language when discussing the future. This view is proved also more suitable for the legal and political realms, where policies and law-making are usually more concerned with present addressees and short term effects. (shrink)

This paper develops a future-oriented and person-centred normative argument based on expectancies that is immune to most of the problems identified in the rights of future persons. The argument unfolds in four parts. The first draws on the notion of expectancies present in inheritance law and maintains that it is possible to formulate a rule of prospective beneficiaries that correlates with entitlements and legitimate claims without necessarily acquiring the status of rights. The second extends expectancies to future persons and concludes (...) that the latter can be considered present holders of such currently binding entitlements. The third section raises the question of whether democracies are bound to a principle of fidelity towards expectancies in such a way that outweighs current people’s rights in cases of conflicts. The response does not prove particularly future-beneficial in such cases. However, section four clarifies why expectancies still carry a crucial moral weight in democracies, one that is not sufficiently established by depersonalised forms of future-oriented ethics. The place of the State in Spinoza's ontology has emerged in scholarly literature as one of the most complex issues involving Spinoza's political thought. At issue is whether Spinoza's State is an actual individual with its own conatus . Some consider it a completely real individual, others say that its individuality can only be metaphoric, whilst others point out the conceptual insufficiency of this polarity for explaining the ontological status of political aggregates and try to overcome it through new concepts, (...) such as the multitude, transindividuality, and figuration. In this paper, each of these interpretations is analyzed and dismissed in favour of a new one stating that Spinoza's State is actually a dynamic network of political concepts operating in resemblance of individuality and reflecting the main characteristics of the modern Nation-State. In representative democracies, the absence of responsiveness by elected officials to the interests of the represented often generates problems of legitimacy, accountability and effectiveness. However, responsiveness also tends to narrow the time horizons of democratic decision-making and promote short-termism. This paper advances the notion that responsiveness to interests involving distant time horizons is possible by reconfiguring the franchise in a time-sensitive and future-oriented way. It is divided into two parts. The first pinpoints a few inconsistencies in the available proposals for (...) making responsiveness and the long term compatible (e.g., promoting youth turnout, narrowing the franchise to robust epistemic fitness, establishing future-oriented institutions). The second advances the creation of temporal electoral circles operating alongside territorial electoral circles in order to prompt responsiveness to multitemporal interests. The conclusion asserts that this kind of franchise design is the best available option for introducing temporal aspects into the character of democratic representation. (shrink)

This paper adopts justificatory moral pluralism – a multilevel framework for justifying the choice by different agents of the most appropriate norms and values to guide their decisions and actions – to climate change. Its main objective is to investigate how ethics may effectively help achieve a better result in deciding how to mitigate, adapt, or compensate by enhancing the moral acceptability of the available policies or actions that are most likely to counter the effects of climate change. JMP presents (...) agents – individuals, nonstate, and state – with a thorough yet flexible process of matching policies and actions with ethical theories, raising the robustness of moral reasons for politically efficient and individually motivating courses of action against climate change. JMP triggers climate responsibility and sensibility in agents, engaging them in discussing and finding out individually and collectively the most acceptable paths for the decarbonisation transition that is fast approaching. The political conception makes sense of human rights strictly in light of their role in international human rights practice, more specifically by describing how they justify interventions against states that engage in or fail to prevent human rights violations. This conception is, therefore, normative and fact-dependent. Beyond this, it does not seem to have much to say about the actual nature of international human rights practice. The argument sustained here reinterprets the political conception by resorting to a heuristic device that (...) explains how normativity can be fact-dependent: the Hartian model. The characteristics of H.L.A. Hart’s rule of recognition are useful to determine the characteristics of human rights practice from the viewpoint of the political conception. Also, they help to overcome some of the problems typically faced by the political conception, such as whether there is only one practice or many, whether the notion of human rights becomes too contingent on the way the world is currently organised, how agents can violate content-changing practices, or how reliance on current states of affairs leaves room for criticism of those states of affairs. Legal positivism understands natural law as performing classifying connections between morality and law as tests of legal validity: if a norm with some pretence to legality contradicts a moral good, it cannot be called a legal norm. The new natural law school, however, claims that natural law develops qualifying connections between morality and law: tests of legal validity are performed by non-moral criteria such as due enactment or efficacy, and morality determines not what the law is, but rather which law (...) is legally binding and which is legally defective. This article will demonstrate that Aquinas’s endorsement of the lexeme lex iniusta non est lex cannot be interpreted in any of these senses. Rather, Aquinas’s strong version of natural law indicates clearly that it can indeed be a classifying criterion of positive law, and that it cannot be the only and exclusive criterion of legal validity. Tomás de Aquino define a alma humana de maneira semelhante a Aristóteles: ela é a forma substancial do corpo humano potencialmente vivo. Todavia, um dos problemas da psicologia tomista consiste, de acordo com D. Abel, em classificar a alma humana por meio de termos comumente utilizados para nomear os compostos hilemórficos, a saber, substância e hoc aliquid. Se a alma humana é parte de um composto, como poderia ser chamada de substância e de hoc aliquid? O objetivo deste artigo consiste (...) em mostrar qual é a estratégia subjacente a esta classificação utilizada por Tomás. Sugerimos que ela remonta a Aristóteles quando ele atribui diferentes significados aos termos substância e hoc aliquid. A novidade de Tomás está em expandir este campo semântico, introduzindo um significado que se aplica exclusivamente à alma humana, a saber, o sentido peculiar. (shrink)

A recent trend in futures studies has called for strengthening the inclusion of future generations in constitutional law. This is problematic from a practical and a normative viewpoint. This paper introduces a future-oriented theory of democratic constitutionalism that overcomes originalism (which privileges the past) and living constitutionalism (which privileges the present) without resorting to the explicit constitutional protection of the yet unborn. It is divided into five sections. The first challenges the notion that the constitutional entrenchment of the non-overlapping future (...) is the best means of implementing long time horizons in democratic legal systems. The second maintains that constitutions are substantive normative expressions of the ultimate justification of authority. The third demonstrates that the substantive dimension of constitutions is cross-temporal and includes what I call ‘the objective interests in the future’ of all members of the people. The fourth connects such objective interests with rights to political participation. The final section focuses on the cross-temporal role of constitutional adjudication. Because rights to political participation include objective interests in the future and necessarily hold the status of constitutional rights in any legitimate democratic constitution, constitutional adjudication must guarantee their enforcement over government action. O objetivo deste trabalho é mostrar como a tradição de matriz africana e afro-brasileira presente no espaço do Terreiro de Candomblé pode ser considerado como um exemplo de Topofilia. É um estudo de Pós-Doutorado desenvolvido no CCS, no NEPPINS, na UFRB. O lócus ocorre na cidade de Cachoeira, no estado da Bahia. A metodologia adotada foi a do trabalho de campo e da observação participante, utilizando-se de publicações locais específicas sobre a temática. Os principais dados demonstram que o espaço do (...) Terreiro de Candomblé, que é considerado sagrado, possui elementos de natureza topofílica, tendo a possibilidade de contribuição positiva para a população negra no Recôncavo Baiano. (shrink)
